Privacy Policy

EverBot LLC respects your privacy. Information you provide is used solely to deliver our programs and services. We do not sell, rent, or share personal information with third parties. Payment information is processed securely through Stripe and Zelle. EverBot does not store payment credentials. Questions: info@everbot.tech.

Cookies & Analytics

EverBot uses Google Analytics to understand how visitors use this website, such as which pages are most visited and how people find us. This is the only non-essential cookie technology on the site. We do not use advertising, retargeting, or cross-site tracking cookies, and we do not sell or share this data.

Your choice: To opt out of Google Analytics, install the Google Analytics Opt-out Browser Add-on (which blocks it across all websites), use your browser’s privacy or tracking-protection settings, or simply email us at info@everbot.tech and we’ll exclude your visits from our reporting.

Third-party embedded content: Some pages embed content from other services: YouTube videos (loaded in privacy-enhanced mode, which does not set tracking cookies until you press play) and Google Calendar. When you interact with this content, the respective provider may process data under its own privacy policy.

Your Data Rights

You may request a copy of, correction of, or deletion of the personal information EverBot holds about you (such as your email address or form submissions) at any time by emailing info@everbot.tech. We will respond within 30 days. We collect only what we need to deliver our services and never sell or rent your information.

Children’s Privacy (COPPA)

EverBot’s AI Club programs serve students, including children under the age of 13. EverBot complies with the Children’s Online Privacy Protection Act (COPPA). For more information about COPPA and your rights, visit the FTC’s COPPA page.

What we collect: We collect only the information necessary for enrollment and student safety: parent or guardian name, email address, and phone number; student first name, last name, and grade level; an emergency contact name and phone number; and any optional health or safety notes a parent chooses to share (such as allergies, medical conditions, or learning needs). We do not collect information directly from children.

Health and safety notes are used only by the club instructor to keep your child safe and supported during sessions. They are stored securely, never used for marketing, and never shared with third parties.

How we use it: Information collected is used solely to manage enrollment, communicate program details, process payment, and deliver the program. It is not used for marketing, sold, rented, or shared with third parties. Enrollment information is stored in a secured database with access restricted to EverBot.

Data retention: Student enrollment information is retained for the duration of the program session and deleted within 90 days of the program’s end, unless the family re-enrolls for a subsequent session.

Parental rights: Parents and guardians may review, correct, or request deletion of their child’s information at any time by contacting info@everbot.tech. Deletion requests will be fulfilled within 30 days.

School-based programs: For programs operating within schools, EverBot follows the school’s applicable data privacy policies and applicable federal and state education privacy laws, including FERPA where applicable.

Photo & Media Consent

EverBot does not photograph, record, or otherwise capture images or video of students without explicit written consent from a parent or guardian. Consent is collected at enrollment, where parents and guardians choose one of three options:

  • Marketing and family sharing: Photos or video may be used in EverBot’s marketing materials (including the EverBot website, social media, and promotional content) and shared with enrolled families. Student last names will never be used in any public-facing materials.
  • Family sharing only: Photos or video may be shared only with enrolled families for program documentation and communication. They will not be published publicly or used in any marketing materials.
  • No photos or video: The student will not be included in any photos or videos.

Consent may be withdrawn at any time by contacting info@everbot.tech. Any materials featuring the student will be removed from public-facing channels within 30 days of a withdrawal request.

Any photography or recording by families, other parents, or school staff during EverBot sessions is the responsibility of those individuals and subject to the school’s applicable policies.

Use of AI Tools

EverBot builds software for small businesses and runs AI education programs for kids. We use AI tools openly in our own work, including AI-assisted development of client builds, research, written deliverables, and program content. That is why our builds cost what they do, and we say so plainly on the What I Build page.

AI-generated content is always reviewed, edited, and approved by EverBot staff before delivery. EverBot takes responsibility for all final deliverables regardless of the tools used to produce them.

Client information shared during an engagement is used only within tools and platforms that EverBot has evaluated for appropriate data handling. We do not input sensitive personal, financial, or proprietary client information into publicly trained AI models without client consent.

AI Club Policies

Payment

Tuition is $275 per student per session, paid at registration through the club page on this website. Payment is by Zelle, which keeps tuition fee-free. If Zelle isn't an option for your family, email jenny@everbot.tech and we'll sort out another way.

Zelle payments: When you register, you receive a unique memo code (for example, EB-7K3M) with payment instructions on screen and by email. The memo code must be included in the Zelle memo field so we can match your payment to your registration. Payment is due by 11:59 PM Mountain Time on the third day after you register, or by the last weekday at least two days before the session begins, whichever comes first. The exact deadline is shown when you register and in your instructions email.

Your child's spot is held until the payment deadline and confirmed when payment is received. If payment is not received by the deadline, the spot is released to other families. You may re-register if spots remain.

Cancellations & Refunds

EverBot’s AI Club is a session-based enrichment program. The following terms apply to all cancellations:

EverBot cancels: If EverBot cancels a session due to instructor illness, instructor scheduling conflict, or any other reason within EverBot’s control, affected families will receive a full refund for that session or a credit toward a future session, at the family’s choice.

Outside EverBot’s control: Sessions canceled due to circumstances outside EverBot’s control are not eligible for refunds or makeup classes. This includes but is not limited to:

  • School or district closures for any reason (weather, emergency, power shut-off, administrative decision)
  • Facility issues at the host location (building lockdown, HVAC failure, loss of utilities, pest control, or similar)
  • Natural disasters, severe weather, or acts of God
  • Public health emergencies or government-ordered closures
  • Any other circumstance beyond EverBot’s reasonable control

EverBot will make reasonable efforts to notify families as early as possible when a session is affected by circumstances outside its control.

Family cancels: If a family withdraws from the program before it begins, a full refund will be issued. Once the program has started, no refunds are issued for remaining sessions.

Make-Up Policy

No make-up classes. Summary and optional at-home activity provided for missed sessions.

Behavior Policy

Students are expected to show kindness, curiosity, and respect toward instructors, peers, and equipment. Disruptive behavior may result in removal from the program. If a student is removed, a prorated refund will be issued for remaining sessions.

Build & Project Policies

These terms apply to EverBot's small-business builds: the Lead-Capture Website, the Never-Miss-a-Lead System, and Custom Ops Builds. Current pricing for every build is published on the What I Build page.

How Engagements Start

Every build starts with a free 30-minute fit call. There is no obligation, and sometimes the honest outcome of the call is that you don't need a build at all.

Custom Ops Builds begin with a free scoping conversation, where EverBot learns how your business actually runs. You leave with a fixed price, at no fee and with no obligation. The detailed written scope is delivered as the first deliverable of the build once the agreement is signed.

Payment

  • Fixed prices. Every build has a fixed price agreed before work begins. There are no surprise invoices and no hourly billing.
  • Deposits. A 50% deposit reserves your build slot; work begins when it clears. The remaining 50% is due at launch, before final handoff. Larger Custom Ops Builds may be split 50/25/25 on agreed milestones.
  • Written agreement. Scope, price, timeline, and payment terms are confirmed in a signed agreement before work begins. Every agreement includes a mutual confidentiality clause protecting both parties.

Cancellations & Refunds

  • Before kickoff: full refund of your deposit, no questions asked.
  • Once the build starts: the deposit is non-refundable and covers work performed. If you cancel mid-build, the deposit is retained and no further payment is owed for work not yet performed.
  • If EverBot cannot complete the project: a prorated refund of payments made will be issued for work not performed.

Post-Launch Fixes

Every build includes 30 days of post-launch fixes at no charge. This covers defects and corrections to the delivered scope. New features and scope additions are quoted separately.

Monthly Service Plans

These terms apply to ongoing monthly services: the website Care Plan, Never-Miss-a-Lead monitoring, and ongoing Custom Ops support plans.

  • All monthly plans are month-to-month. Cancel anytime with 30 days written notice. No refunds for the current billing period.
  • One-time setup fees are non-refundable once the system is live, per the build terms above.
  • If you cancel a monthly plan, EverBot hands off any accounts, credentials, and configurations you own. Ongoing subscriptions to third-party tools required to keep a system running become your responsibility at handoff.

Confidentiality

All client business information shared during any EverBot engagement is confidential and will not be disclosed to third parties without written permission. Every build agreement includes a mutual confidentiality clause: your business information is protected, and EverBot's methods, templates, and pricing terms are protected in return. A standalone mutual NDA is available on request before any engagement, including before the fit call. The only standing exception is the anonymized portfolio use described below, which never includes identifying information and which you may opt out of entirely in your agreement.

Portfolio & Case Study Use

EverBot may use anonymized or generalized descriptions of engagements in its portfolio, marketing materials, website, and case studies. Anonymized means no identifying information about the client or their business is included. Named references, meaning identifying a client by name, require separate written opt-in consent and are never assumed.

No Guarantee of Business Outcomes

EverBot builds are delivered with professional care and tested before launch. However, business results (leads, bookings, revenue, time saved) depend on your market, your pricing, your follow-through, and factors outside EverBot's control. Industry statistics cited on this website describe published research, not a promise of your results. EverBot makes no guarantees of specific business outcomes.

Intellectual Property

Ownership transfers on full payment. Ownership of all custom deliverables, including websites, custom tools, automations, written materials, and any other work product created specifically for the client, transfers to the client upon receipt of full payment. Until full payment is received, EverBot LLC retains all ownership rights to the work product. EverBot reserves the right to withhold delivery of final files, credentials, and access until payment is received in full.

Non-payment. If a client fails to make any required payment, EverBot LLC retains full ownership of all work product created under the engagement. The client has no claim to any deliverable, file, credential, codebase, or other work product for which full payment has not been received. EverBot reserves the right to remove, unpublish, or revoke access to any deliverable in the event of non-payment.

Written scopes. The detailed written scope delivered at the start of a build is part of the build's work product and is subject to the payment-contingent ownership terms above.

EverBot retains its methods. EverBot retains ownership of its general methodologies, frameworks, processes, templates, and approaches used in delivering services. These are not transferred to the client and may be used in future engagements with other clients without disclosing confidential client information.

Third-Party Tools. EverBot builds may involve third-party software, platforms, and tools (such as hosting providers, form and booking services, and messaging platforms). Ownership and licensing of third-party tools are governed by those tools' own terms of service. EverBot is not responsible for changes to third-party tools, pricing, or availability after an engagement concludes. Ongoing subscriptions to third-party tools required to operate a deliverable are the client's responsibility after handoff.

Limitation of Liability

To the fullest extent permitted by applicable law, EverBot LLC's total liability for any claim arising from or related to services rendered, whether in contract, tort, or otherwise, is limited to the total amount paid by the client for the specific service giving rise to the claim.

EverBot LLC is not liable for any indirect, incidental, consequential, or punitive damages, including but not limited to lost profits, lost revenue, lost data, or business interruption, even if EverBot has been advised of the possibility of such damages.

This limitation applies to all EverBot services: builds, monthly service plans, AI Club programs, and school events.

School Events & Demonstrations

Insurance

EverBot LLC carries general liability insurance. COI provided on written request at least 14 days before the event.

Payment

Full payment required before event date. Terms in signed event agreement.

Equipment & Safety

EverBot staff operate all robotic equipment at all times. Guests must not touch or control the robot unless directed during a supervised activity. Event host assumes responsibility for damage caused by attendees or third parties.

Venue Responsibility

Client or host is responsible for venue fees, permits, power access, and additional requirements.

Cancellations / Force Majeure

EverBot reserves the right to cancel or reschedule due to weather, venue issues, power failure, illness, or circumstances outside our control, without penalty beyond refund of payments made.

Dispute Resolution & Governing Law

Dispute Resolution

EverBot is committed to resolving concerns fairly and promptly. If you have a question or concern about any EverBot service, please contact us at info@everbot.tech before pursuing formal action. We will respond within five business days and make a genuine effort to resolve the issue directly.

Governing Law

These policies and any disputes arising from EverBot’s services are governed by the laws of the State of Colorado, without regard to its conflict of law provisions. Any legal action or proceeding arising under these policies shall be brought exclusively in the state or federal courts located in Jefferson County, Colorado.
